AGROTRADE Wins Court Case Against the Russian Federation Over Compensation for Damages

AGROTRADE Group has won a court case against the Russian Federation seeking compensation for damages amounting to UAH 117 million caused during the occupation of the Kharkiv region.

The Commercial Court of Kharkiv Region fully satisfied the claim filed by AGROTRADE Group company LLC «Ukrzernoprom Shevchenkove,» located in the village of Novomykolaivka, Kupiansk district, and ordered the Russian Federation to pay more than UAH 117 million in damages caused during the occupation and hostilities in Kharkiv Region in 2022.

The lawsuit was filed against the Russian Federation represented by its Ministry of Justice.

The court established the fact of significant property losses suffered by the enterprise and confirmed a direct causal link between the damages and the military aggression of the Russian Federation. According to an independent expert assessment, the total amount of losses exceeded UAH 117 million. The damages included losses resulting from the destruction and theft of grain stocks, damage to production and property infrastructure, as well as the theft and destruction of vehicles and other company assets during the occupation of the territory.

At the same time, there is currently no practical mechanism for enforcing such court decisions. It is expected that compensation may be provided in the future through international reparations mechanisms or from frozen assets of the aggressor state.

«This decision is the result of the company’s systematic work to document and legally confirm damages caused by the war. We consistently record losses, build evidence bases, and apply to courts. Such decisions are of fundamental importance because they officially confirm the responsibility of the Russian Federation for the damage caused. This is one of the first steps in a series of similar cases that we are already pursuing,» commented Anzhelika Vahorovska, Deputy Director of the Legal Department of AGROTRADE Group.

For AGROTRADE Group, this ruling is the first in a series of lawsuits seeking compensation for damages suffered by the company’s enterprises as a result of hostilities in Kharkiv and other regions of Ukraine.

Preparations are currently underway for new claims involving other affected enterprises. All losses are being systematically recorded and documented with the involvement of independent experts and relevant authorized bodies.
